1 Acceptance of Terms

By registering for an account or using the Service, you confirm that you are at least eighteen (18) years old and that you have the legal capacity to accept these Terms. If you are under 18, you are not permitted to use the Service under any circumstance. If you do not agree with these Terms, please do not access or use the Service.

2 Account Registration and Responsibility

You agree to provide accurate, current and complete information when registering and to keep your account credentials secure.

You are responsible for all activities that take place under your account. You will promptly notify us of any unauthorized use or breach of your account.

3 Your Data, Images & AI-Processing Consent

By providing any User Data (including photos of your face that you upload so we can generate your personalized AI avatar, clothing or metadata, preferences, style chat interactions, AI inputs) you explicitly and freely consent to our processing of such data for the purposes described below:

To generate your personalized AI avatar from the facial photos you upload, and to enable virtual styling features on that avatar.
To store and manage your digital wardrobe and styling suggestions.
To personalise your experience, including feed content and styling recommendations.
To train and improve our AI systems and algorithms using anonymised or aggregated derivatives of your data only. We do not use identifiable facial images or private wardrobe images for general model training.
To perform analytics and platform optimisation. We do not use your facial images or AI avatar for marketing activities or commercial campaigns.

Avatar Acknowledgments

You explicitly acknowledge and consent that:

The digital avatar generated by FASHI is a stylized AI representation based on your facial likeness and is never displayed without clothing.

The avatar is always generated and displayed with a neutral base outfit (top and bottom) that cannot be removed.

FASHI's virtual styling features allow you to change outfits on your avatar, but not to remove clothing from it.

d

FASHI does not use your facial images to identify you, to verify your identity, or for facial recognition purposes.

Licence Grant

You grant FASHI a non-exclusive, worldwide, royalty-free licence strictly limited to the purposes described above to use your uploaded content (images, avatar, wardrobe metadata, chat inputs) solely to operate the Service. This licence terminates when you delete your content or your account, subject to legal retention requirements.

You understand that our AI and automated systems will process your User Data and that the results (avatars, outfit suggestions, virtual styling previews) are generated automatically and may occasionally contain inaccuracies. You may request deletion of your avatar, virtual wardrobe and associated data at any time (see Section 8).

4 Prohibited Conduct

You agree not to engage in any of the following:

Upload or share unlawful, fraudulent, hateful, harassing, pornographic, violent or otherwise objectionable content.

Upload photos of any person other than yourself without their explicit and verifiable consent.

Attempt to use the Service to generate, request, or produce any nude, sexually suggestive, or otherwise objectionable imagery. The Service is designed to prevent such outputs and any attempt to circumvent these safeguards is strictly prohibited.

Impersonate any person or entity, or misrepresent your affiliation or identity.

Use the Service for any commercial purpose not authorised.

Reverse-engineer, circumvent or misuse our AI systems or exploit bugs.

Interfere with or bypass any security or authentication features of the Service.

5 Content Ownership, Licence & Removal

You retain all rights to Your Content. You represent and warrant that you have the necessary rights in the content you upload and that your content does not violate any third-party rights.

We may remove or disable access to content we believe violates these Terms.

6 Termination & Suspension

We may suspend or terminate your access to the Service at our sole discretion if you violate these Terms, or if we believe your account or content threatens the safety, security or integrity of the Service. On termination, you remain responsible for any accrued obligations, and we may retain certain data for legal, compliance or legitimate business purposes under our Privacy Policy.

7 Your Rights Under Data Protection Laws

If you are based in the European Economic Area (EEA) or UK, you have the following rights under applicable data protection law (including GDPR):

Access. Access your User Data and receive a copy in a structured, commonly-used format.

Rectification. Rectify or update your information.

Erasure. Request deletion ("right to be forgotten") of your data, avatar, virtual wardrobe or profile, including the facial images used to generate your avatar (subject to retention limits).

Objection. Object to or withdraw consent to data processing (including marketing or profiling).

Restriction & Portability. Request restriction of processing or portability of your data.

Complaint. Lodge a complaint with your local data protection supervisory authority in your country of residence.

8 Marketing Communications & Your Choices

By accepting these Terms you agree to receive service communications and promotional offers via email, in-app messaging or push notifications.

You may withdraw your consent to promotional communications at any time via your account settings or by contacting us.

You cannot opt-out of essential service notifications (such as account verification and safety alerts).

9 Changes to These Terms

We may amend or replace these Terms at any time. If we make material changes, we will notify you (e.g., via email or in-app notification) and update the "Last updated" date. Your continued use of the Service after that date constitutes acceptance of the revised Terms.

10 Disclaimer, Limitation of Liability & Indemnity

a. Disclaimer of Warranties

The FASHI Service is provided on an "as-is" and "as-available" basis. While we strive to maintain the highest quality and reliability, we do not guarantee that the Service will be uninterrupted, error-free, secure, or free of viruses or harmful components.

To the extent permitted by law, FASHI disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

b. Limitation of Liability

To the fullest extent permitted by applicable law, FASHI AI Solutions LLC, its affiliates, officers, directors, employees, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenues, data, goodwill, or other intangible losses.

c. Indemnification

You agree, to the extent permitted by law, to indemnify and hold harmless FASHI AI Solutions LLC, its affiliates, officers, directors, employees, licensors, and agents from and against any and all claims, damages, losses, liabilities, and expenses arising out of or related to your use of the Service.

11 Governing Law & Dispute Resolution

a. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, excluding its conflict-of-law principles. Any disputes arising out of or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts located in the State of Delaware, United States.

b. Dispute Resolution

Before initiating formal legal proceedings, you agree to first contact FASHI at support@fashi.us to attempt an amicable resolution.
